What is Following Too Closely?

Following too closely occurs when a driver does not leave enough space between their vehicle and the one in front, creating a risk of collision.

Even if no damage occurs, a conviction for following too closely can lead to fines, licence suspensions, and higher insurance rates.

Legal Definition

Under Ontario’s Highway Traffic Act (Section 158):

"The driver of a motor vehicle or street car shall not follow another vehicle or street car more closely than is reasonable and prudent having due regard for the speed of the vehicle, the traffic, and the conditions of the highway."

Penalties

Conviction for following too closely can result in:

  • Fines: $110–$500
  • Demerit Points: 4 points added to your driving record
  • Driver’s Licence Suspension: Up to 30 days
  • Insurance Impact: Conviction remains on your record and may increase premiums

Even minor offences like following too closely can have long-term financial consequences if added to your driving history.
